By accepting these Terms of Use, you will be granted a non-exclusive, royalty-free, limited, revocable license to use ProtoSphere, subject to these Terms of Use. Your license does not grant you any ownership rights to ProtoSphere or to the account which you use to access ProtoSphere, both of which at all times will remain the property of ProtonMedia. You may provide access to ProtoSphere to other members of your organization at no additional cost, but you agree that you and the other users in your organization will use ProtoSphere for demonstration and evaluation purposes only and not for business purposes (including, without limitation, training or inter-company communication) or personal gain. You also agree that you will not: (i) display material that contains nudity or pornography or is otherwise indecent or sexually explicit; (ii) use profanity or expressions of racism, bigotry, intolerance, or hatred; (iii) display content that harasses other users or is abusive, defamatory, offensive, disruptive or inflammatory; (iv) include content that violates any laws, infringes on third party rights, or promotes or condones illegal activity; (v) impersonate any other person or misrepresent an affiliation with any entity; (vi) attempt to decompile, reverse engineer or otherwise attempt to access ProtoSphere's source code; (vii) copy, republish, exploit, or disseminate any part of the ProtoSphere site or use any trademark or other intellectual property right of ProtonMedia without ProtonMedia's prior written consent; (viii) post or transmit any content that contains any viruses, spyware, worms or other programming routines intended to damage or interfere with the use of ProtoSphere; (ix) disclose personal information about another ProtoSphere user without that user's consent; or (x) transmit or post any advertising or promotional materials or send unsolicited "spam" emails to other ProtoSphere users.

You acknowledge that ProtonMedia does not actively monitor the activities or regulate the content on this site but will take action to investigate reported violations of these Terms of Use. You may report violations of these Terms of Use by sending an email to ProtoSphereAdmin@protonmedia.com. You agree that you are solely responsible for the content that you post and for understanding how laws relating to the protection of intellectual property may apply to your content. You will indemnify ProtonMedia for any losses or damages incurred by ProtonMedia as a result of your use of ProtoSphere and/or the content you post. You release ProtonMedia, its shareholders, officers, directors, employees and agents from all claims, liabilities and damages of every kind arising out of or relating to your use of ProtoSphere, including without limitation claims arising from disputes with other ProtoSphere users.

protonMEDIA reserves the following rights:

• to terminate any license to use ProtoSphere at any time and for any reason or no reason
• to refuse to grant a license to any prospective user
• to interrupt service with or without notice for any reason
• to remove content that, in ProtonMedia's sole discretion, violates these Terms of Use

You agree that ProtonMedia will not be liable for any service interruptions, and you accept the license to use ProtoSphere on an "as is" basis. PROTONMEDIA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL PROTONMEDIA BE LIABLE TO YOU FOR SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGE, INCLUDING DAMAGES FOR LOST PROFITS.
